Términos del servicio

Effective Date: August 10, 2026

Overview

This website is operated by Britique Boutique LLC, doing business as Britique Boutique. Throughout this website, the terms “Britique Boutique,” “we,” “us,” and “our” refer to Britique Boutique LLC.

Britique Boutique offers this website, including all information, features, tools, products, services, and other content made available through the website, conditioned upon your acceptance of these Terms of Service and all policies and notices referenced in them.

By visiting our website, creating an account, submitting information, placing an order, using local store pickup, or purchasing a product or service from us, you engage in our “Service” and agree to be bound by these Terms of Service.

These Terms apply to all users of the website, including browsers, customers, account holders, vendors, and individuals who submit content.

Please read these Terms carefully before accessing or using our website. If you do not agree to these Terms, you may not access the website, place an order, or use our Services.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer products and Services to you.

Section 1 — Incorporated Policies

The following Britique Boutique policies are incorporated into and form part of these Terms:

Return & Store Credit Policy:
https://www.britiqueboutique.com/policies/refund-policy

Shipping & Store Pickup Policy:
https://www.britiqueboutique.com/policies/shipping-policy

Privacy Policy:
https://www.britiqueboutique.com/policies/privacy-policy

Affirm Financing Disclosures:
https://www.affirm.com/disclosures

Any promotion-specific terms, product restrictions, giveaway rules, event terms, or other policies displayed on our website also apply when relevant.

If a conflict exists between these Terms and a more specific Britique Boutique policy, the more specific policy will generally control the matter it specifically addresses.

Section 2 — Eligibility and Online Store Terms

You must be at least the age of majority in your state of residence to make a purchase, or the purchase must be made with the involvement and permission of a parent or legal guardian.

By placing an order, you represent that:

  • You are legally authorized to use the payment method submitted
  • The information you provide is truthful, current, complete, and accurate
  • Your purchase is for a lawful purpose
  • You will not use our products or Services in violation of applicable law
  • You will not transmit viruses, malware, destructive code, or other harmful material through our website

A violation of these Terms may result in cancellation of an order, restriction of an account, refusal of Service, or termination of access to our website, subject to applicable law.

Section 3 — General Conditions

We reserve the right to refuse, restrict, suspend, or terminate Service to any person when permitted by law, including in response to suspected fraud, abusive conduct, policy violations, security concerns, unauthorized transactions, harassment, or unlawful activity.

Your use of the website must not interfere with its security, functionality, availability, or operation.

You may not reproduce, duplicate, copy, sell, resell, exploit, or commercially use any portion of the Service without our prior written permission.

Headings are included for convenience and do not limit or affect the meaning of these Terms.

Section 4 — Orders and Acceptance

Submitting an order does not guarantee that the order has been accepted or will be fulfilled.

An automated order confirmation acknowledges that we received your order. It does not constitute final acceptance, guarantee product availability, or create an obligation to fulfill an order containing an error.

We reserve the right to review, hold, limit, decline, or cancel an order before fulfillment for reasons including:

  • Suspected fraud or unauthorized payment activity
  • High-risk fraud indicators
  • Unverifiable customer information
  • Billing or shipping address discrepancies
  • Invalid, incomplete, or undeliverable addresses
  • Inventory shortages or inventory errors
  • Pricing, promotional, or technical errors
  • Duplicate or unusual purchasing activity
  • Suspected unauthorized resale or commercial purchasing activity
  • Product or geographic restrictions
  • Failure to provide requested verification
  • Security, legal, or fulfillment concerns

If we cancel an order after payment has been processed, we will issue an appropriate refund to the original payment method unless another resolution is required or permitted by applicable law.

We may limit quantities purchased per person, household, account, payment method, billing address, shipping address, or order.

Section 5 — Order Changes and Cancellations

Orders may begin processing immediately after they are placed.

We cannot guarantee that we can cancel or modify:

  • Products
  • Sizes
  • Colors
  • Quantities
  • Shipping addresses
  • Customer information
  • Delivery methods
  • Discount codes
  • Payment methods

Customers are responsible for carefully reviewing their order information before completing checkout.

If you need to request a change, please contact Britique Boutique as soon as possible. Approval is not guaranteed and depends on the fulfillment status of the order.

If shipping is selected and paid for at checkout and the customer later requests to change the order to local pickup, the request must be made before the order has shipped and is subject to Britique Boutique’s approval.

Approved shipping-to-pickup changes will be handled according to our Shipping & Store Pickup Policy, including applicable store-credit and processing/order-change fee terms.

Once an order has shipped or otherwise entered a stage of fulfillment that cannot reasonably be reversed, changes cannot be made.

Our inability to modify an order does not make the order eligible for cancellation, refund, or return outside the terms of our posted policies.

Section 6 — Products and Product Information

Certain products may be available exclusively online, in store, or in limited quantities.

We make reasonable efforts to display product photographs, colors, measurements, descriptions, and other information accurately. However:

  • Colors may appear differently depending on the screen, device, lighting, or display settings
  • Pattern placement may vary between individual products
  • Measurements are approximate
  • Fit descriptions and sizing recommendations are provided as general guidance and are not guarantees
  • Handmade, natural, embellished, printed, or individually produced products may have reasonable variations
  • Product packaging may change without notice
  • Minor differences that do not materially affect a product’s intended use may not constitute a defect

All product purchases are subject to our Return & Store Credit Policy.

We reserve the right to:

  • Limit product quantities
  • Discontinue products
  • Correct product information
  • Modify descriptions
  • Update prices
  • Restrict sales by customer, location, or jurisdiction
  • Decline orders that appear intended for unauthorized resale

Any offer made through the website is void where prohibited.

Section 7 — Pricing, Promotions, and Availability

All prices are displayed in United States dollars unless otherwise stated.

Prices, products, discounts, and promotions may change without notice. A price change does not apply retroactively to a completed order unless required by law.

Promotions may:

  • Be available for a limited time
  • Exclude certain products or brands
  • Require a minimum purchase
  • Apply only to qualifying merchandise
  • Be limited to one use per person, household, customer, or order
  • Be unavailable with other discounts
  • Be offered while supplies last
  • Be subject to separate terms

Discounts cannot be combined unless expressly stated.

Discount codes must be entered and successfully applied before checkout is completed. We do not guarantee that a discount can be added after an order has been placed.

Free gifts, promotional items, and gifts with purchase are available only while supplies last and may not be exchanged for cash, store credit, or another item unless we expressly agree otherwise.

Inventory availability is not guaranteed. An item may become unavailable after an order is submitted due to simultaneous purchases, inventory discrepancies, damage, theft, technical errors, or other circumstances.

Section 8 — Errors, Inaccuracies, and Omissions

Our website may occasionally contain typographical errors, inaccuracies, or omissions involving:

  • Product descriptions
  • Prices
  • Promotions
  • Discounts
  • Availability
  • Shipping charges
  • Processing or delivery estimates
  • Images
  • Product specifications

We reserve the right to correct errors, update information, or cancel affected orders when reasonably necessary, including after an order has been submitted.

If an order is canceled because of an error, we will issue an appropriate refund for the canceled portion of the order.

We are not obligated to honor an obvious pricing, promotional, or technical error when doing so would be commercially unreasonable or contrary to applicable law.

Section 9 — Billing, Payment, and Account Information

You agree to provide current, complete, and accurate billing, payment, shipping, contact, and account information.

You agree to promptly update your information when necessary so that we can process transactions and communicate with you.

By submitting payment information and completing checkout, you represent and acknowledge that:

  • You are legally authorized to use the payment method
  • The payment information you provide is accurate
  • You authorize Britique Boutique and our payment providers to charge the total amount displayed at checkout
  • You authorize applicable merchandise charges, taxes, shipping charges, and other fees clearly disclosed before purchase
  • You have had an opportunity to review the order total before completing payment
  • Your transaction is subject to these Terms and the policies incorporated into them

We may request additional information or identity verification before processing or fulfilling an order.

Failure to provide requested verification may result in the order being held or canceled.

Section 10 — Financing and Third-Party Payment Services

We may offer financing, installment payments, accelerated checkout, digital wallets, or other payment services provided by third parties, including Affirm, Afterpay, Shop Pay, PayPal, or other providers.

These services are offered and administered by the applicable third-party provider and may be subject to:

  • Eligibility requirements
  • Credit approval
  • Separate terms and conditions
  • Interest or finance charges
  • Late fees
  • Payment schedules
  • Provider-specific privacy practices

Britique Boutique does not make third-party lending or credit-approval decisions and does not guarantee eligibility, approval, payment terms, or financing availability.

Customers using Affirm should review Affirm’s applicable financing disclosures:

https://www.affirm.com/disclosures

Questions or disputes concerning financing approval, payment schedules, lending decisions, financing charges, or third-party account administration should generally be directed to the applicable payment provider.

Our Return & Store Credit Policy continues to apply to merchandise purchased through a third-party payment provider. A merchandise return does not automatically cancel every financing obligation until the applicable provider processes the adjustment.

Section 11 — Gift Cards and Store Credit

Gift cards and store credit may be used only in accordance with the terms displayed at purchase or issuance.

Unless otherwise required by law:

  • Gift cards and store credit are not redeemable for cash
  • Store credit is non-transferable
  • Gift cards and store credit may not be used to purchase additional gift cards when restricted by our payment platform
  • Lost, stolen, shared, or improperly used gift-card or store-credit codes may not be replaceable

Britique Boutique is not responsible for unauthorized use after a gift-card or store-credit code has been delivered to the customer.

Customers are responsible for maintaining the security of their accounts, codes, and login information.

We reserve the right to investigate, suspend, or cancel gift cards or store credits associated with suspected fraud, abuse, chargebacks, unauthorized transactions, duplicate credits, or technical errors.

Nothing in this section limits rights that cannot legally be waived.

Section 12 — Shipping and Delivery

All shipping orders are governed by our Shipping & Store Pickup Policy:

https://www.britiqueboutique.com/policies/shipping-policy

Customers are responsible for providing a complete and accurate shipping address and monitoring tracking information.

Carrier delivery estimates are not guaranteed by Britique Boutique.

Responsibility for carrier delays, lost packages, packages marked delivered, shipping damage, incorrect addresses, refused shipments, unclaimed shipments, and returned packages is determined according to our Shipping & Store Pickup Policy and applicable law.

Section 13 — Local Store Pickup

Local store pickup is available when offered through our website.

Customers must wait until they receive a Ready for Pickup notification before arriving at the boutique. An order confirmation alone does not mean an order is ready for pickup.

The person collecting an order must present or provide, when requested:

  • A valid government-issued photo ID
  • The order confirmation or Ready for Pickup notification
  • Proof of authorization from the purchaser, when applicable
  • A signature or other acknowledgment confirming receipt, when requested

Orders will only be released to the purchaser or an authorized pickup person whose identity can be reasonably verified.

If someone other than the purchaser will collect the order, the purchaser must provide written authorization by email to shop@britiqueboutique.com before pickup.

The email should include:

  • The applicable order number
  • The authorized pickup person’s full name

Whenever reasonably possible, authorization should be sent from the email address associated with the original order.

Britique Boutique may decline verbal-only authorization or refuse to release an order when the purchaser’s identity, authorization, pickup person, or order information cannot be reasonably verified.

The order will not be marked as picked up until it has been physically released to the verified purchaser or authorized pickup person.

Once an order has been verified and physically released, responsibility for the merchandise transfers to the person receiving the order, subject to any rights that cannot legally be waived.

Additional local pickup and shipping-to-pickup terms are contained in our Shipping & Store Pickup Policy.

Shopify’s pickup workflow specifically allows merchants to mark an order as picked up after the customer collects it and recommends confirming the order number and customer name during pickup.

Section 14 — Returns, Store Credit, and Final-Sale Items

All returns, store credits, non-returnable merchandise, final-sale merchandise, damaged or defective items, and return-shipping obligations are governed by our Return & Store Credit Policy:

https://www.britiqueboutique.com/policies/refund-policy

Britique Boutique does not offer money-back refunds to the original form of payment for ordinary eligible returns.

Eligible returns are processed as store credit according to the requirements and exclusions contained in our Return & Store Credit Policy.

Customers are responsible for reviewing the Return & Store Credit Policy before placing an order.

Final-sale merchandise remains subject to the exclusions stated in that policy regardless of the payment method used.

Section 15 — Payment Disputes and Chargebacks

We encourage customers to contact Britique Boutique promptly regarding an order, payment, return, delivery, pickup, product, or store-credit concern so that we have a reasonable opportunity to investigate and address the matter.

If you believe:

  • A transaction amount is incorrect
  • Merchandise was not received
  • Merchandise arrived damaged or defective
  • An item was materially different from its description
  • A return or store credit was not properly processed
  • A transaction was unauthorized
  • Another order-related issue has occurred

please contact shop@britiqueboutique.com promptly with your order information and a description of the concern.

By completing a purchase, you acknowledge that the amount displayed at checkout, including applicable merchandise charges, taxes, shipping charges, and other disclosed fees, is authorized by you or by the lawful holder of the payment method.

You further acknowledge that the transaction is subject to these Terms and the Britique Boutique policies incorporated into them, including our Return & Store Credit Policy and Shipping & Store Pickup Policy.

Customers agree not to knowingly submit false, misleading, duplicate, or fraudulent chargeback claims or misrepresent the facts surrounding a transaction, delivery, return, store credit, or pickup.

When responding to a payment dispute, chargeback, fraud investigation, or payment-provider inquiry, Britique Boutique may provide relevant information and documentation to Shopify, the payment processor, card issuer, financial institution, financing provider, card network, platform, or other investigating party.

Depending on the nature of the dispute, such information may include:

  • Order details
  • Itemized transaction records
  • Checkout totals and payment records
  • Fraud-screening results
  • Billing and shipping information
  • Address-verification or security-code results available through our payment platform
  • IP address, device, or location information available through our platform
  • Order history
  • Shipping and tracking information
  • Fulfillment dates and records
  • Delivery confirmation
  • Ready for Pickup records
  • Verified or signed pickup records
  • Written authorization for alternate pickup persons
  • Customer emails, messages, or other communications
  • Product descriptions, photographs, and listing information
  • Return records
  • Store-credit records
  • Refund records
  • Copies of applicable policies
  • Records concerning when or where policies were presented to the customer
  • Evidence of policy acceptance or checkout completion
  • Other information reasonably relevant to establishing the legitimacy and fulfillment of the transaction

Britique Boutique may preserve transaction, order, fulfillment, pickup, return, fraud-prevention, and customer-service records for legitimate business, legal, security, dispute-resolution, and chargeback purposes in accordance with our Privacy Policy.

Nothing in these Terms eliminates, restricts, or waives a customer’s lawful right to dispute a genuinely unauthorized transaction or exercise any right that cannot legally be waived under applicable law or payment-network rules.

Shopify currently identifies many of these same categories—such as billing information, fulfillment timestamps, tracking, customer communications, IP/device information, product descriptions, and refund-policy evidence—as potentially relevant evidence depending on the reason for a chargeback.

Section 16 — Informal Dispute Resolution

Before filing a lawsuit or other formal legal proceeding concerning an order, product, transaction, or use of the Services, the customer and Britique Boutique LLC agree, to the extent permitted by law, to make a good-faith effort to resolve the dispute informally.

The customer should send a written notice describing the dispute to:

Britique Boutique LLC
89 Sandy Run Road, Suite 400
Bonaire, GA 31005
Email: shop@britiqueboutique.com

The notice should include:

  • The customer’s full name
  • The applicable order number, when relevant
  • Contact information
  • A description of the dispute
  • The requested resolution

Britique Boutique LLC will have up to 30 days after receiving a reasonably complete notice to investigate and respond before either party initiates a formal legal proceeding, to the extent such a waiting period is legally enforceable.

This informal-resolution period does not apply when immediate action is reasonably necessary to:

  • Prevent irreparable harm
  • Preserve a legal filing deadline
  • Pursue an eligible small-claims matter
  • Address fraud, theft, misuse, or a security concern
  • Exercise a right that cannot legally be restricted

Nothing in this section eliminates or limits any nonwaivable consumer right or legally protected right to dispute an unauthorized payment.

Section 17 — Optional and Third-Party Tools

We may provide access to third-party tools, platforms, applications, integrations, or services that we do not own or control.

These tools may be provided “as is” and “as available.” Your use of them may be subject to the applicable third party’s terms, conditions, privacy practices, and availability.

Britique Boutique is not responsible for the operation, accuracy, security, availability, lending decisions, or independent conduct of third-party services except to the extent required by law.

You are responsible for reviewing applicable third-party terms before using those services.

Section 18 — Third-Party Links

Our website may include links to websites, products, services, social platforms, financing providers, or content operated by third parties.

We do not control and are not responsible for the accuracy, content, availability, security, products, services, policies, or practices of unaffiliated third-party websites except where applicable law provides otherwise.

Accessing a third-party website is at your discretion.

Complaints or questions about a third-party product, service, account, or website should generally be directed to the applicable third party.

Section 19 — User Content, Reviews, and Submissions

You may submit reviews, photographs, videos, comments, contest entries, feedback, suggestions, or other content to Britique Boutique.

By voluntarily submitting content for publication, promotion, a contest, a social-media feature, or other public use, you represent that:

  • You own or have permission to submit the content
  • The content is accurate and lawful
  • The content does not violate another person’s intellectual-property, privacy, publicity, contractual, or proprietary rights
  • The content does not contain malicious code
  • The content is not defamatory, threatening, obscene, deceptive, discriminatory, or otherwise unlawful

For content voluntarily submitted for public, promotional, or marketing use, you grant Britique Boutique a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, publish, display, distribute, and share that content in connection with our business and marketing.

This license does not automatically apply to private customer-service communications, payment information, confidential information, or photographs or documentation provided solely to resolve an order issue.

We may monitor, refuse, edit, or remove publicly submitted content when we reasonably determine that it violates these Terms, applicable law, platform rules, or another person’s rights.

We are not obligated to publish, retain, compensate, or respond to user submissions.

Section 20 — Intellectual Property

The website and its content are owned by, licensed to, or lawfully used by Britique Boutique LLC.

Protected content may include:

  • The Britique Boutique name
  • Logos, crests, monograms, and branding
  • Website text
  • Product descriptions
  • Photographs
  • Videos
  • Graphics
  • Designs
  • Advertisements
  • Social-media content
  • Marketing materials
  • Layouts and visual elements

You may not copy, reproduce, modify, distribute, publish, sell, exploit, scrape, download, or create derivative works from our protected content without prior written permission, except as otherwise permitted by law.

Third-party trademarks, product names, logos, photographs, and other intellectual property belong to their respective owners. Their appearance on our website does not transfer ownership rights to you.

Section 21 — Personal Information and Privacy

Your submission and our handling of personal information are governed by our Privacy Policy:

https://www.britiqueboutique.com/policies/privacy-policy

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Please notify us promptly if you believe your account or payment information has been accessed or used without authorization.

Section 22 — Prohibited Uses

You may not use our website, Services, accounts, content, or systems:

  • For an unlawful or fraudulent purpose
  • To violate applicable federal, state, local, or international law
  • To infringe intellectual-property or proprietary rights
  • To harass, abuse, threaten, defame, intimidate, or unlawfully discriminate
  • To submit false, misleading, or fraudulent information
  • To impersonate another person
  • To upload malicious code
  • To interfere with the website’s operation or security
  • To collect another person’s information without authorization
  • To spam, phish, scrape, crawl, spider, pretext, or improperly data mine
  • To circumvent security, purchase limits, access controls, or fraud-prevention measures
  • To make unauthorized commercial use of our content
  • To place orders using stolen or unauthorized payment information
  • To misuse promotions, discount codes, gift cards, store credit, return privileges, or chargeback procedures

We may restrict or terminate access for violations of these prohibitions, subject to applicable law.

Section 23 — Accuracy and Availability of Website Information

Information made available through the website may not always be complete, current, or error-free.

Historical information is provided for reference and may no longer be current.

We may update, modify, remove, suspend, or discontinue any part of the website or Service at any time, subject to applicable law.

We do not guarantee that the website will always be uninterrupted, secure, available, or free from technical errors.

Section 24 — Disclaimer of Warranties

To the maximum extent permitted by applicable law, the website and Services are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The website will always be uninterrupted or error-free
  • Every defect will be corrected immediately
  • The website will be free from all harmful components
  • Every product will satisfy every customer’s personal preference or expectation
  • Third-party services will always be available

Any warranties, rights, or remedies that cannot legally be excluded remain in effect.

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be waived.

Section 25 — Limitation of Liability

To the maximum extent permitted by applicable law, Britique Boutique LLC and its owners, officers, employees, agents, contractors, affiliates, suppliers, service providers, and licensors will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising from the use of, or inability to use, the website, Services, content, or products.

This may include lost profits, lost revenue, lost data, business interruption, replacement costs, or similar losses.

Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Section 26 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Britique Boutique LLC and its owners, officers, employees, agents, contractors, affiliates, suppliers, service providers, and licensors from third-party claims, liabilities, damages, costs, or reasonable attorneys’ fees arising from:

  • Your material violation of these Terms
  • Your unlawful use of the website or Services
  • Your violation of another person’s rights
  • Content you submit
  • Fraudulent or unauthorized conduct attributable to you

This section does not require you to indemnify Britique Boutique for conduct for which indemnification cannot lawfully be required.

Section 27 — Events Beyond Our Reasonable Control

Britique Boutique is not responsible for delays or failures caused by events outside our reasonable control, including:

  • Severe weather
  • Natural disasters
  • Fires
  • Floods
  • Public emergencies
  • Government actions
  • Labor interruptions
  • Transportation or carrier disruptions
  • Supply-chain interruptions
  • Utility, internet, or technology outages
  • Cyber incidents
  • Epidemics or pandemics
  • Acts of war, terrorism, or civil unrest

We will make reasonable efforts to communicate material delays and fulfill our obligations when reasonably possible.

This section does not permit us to retain payment indefinitely when applicable law requires a refund, cancellation option, or other remedy.

Section 28 — Termination

These Terms remain effective until terminated by you or Britique Boutique.

You may stop using our website and Services at any time.

We may suspend or terminate access if we reasonably believe you have violated these Terms, engaged in fraud or abuse, created a security risk, or used the Service unlawfully.

Termination does not eliminate obligations, rights, payments, liabilities, or claims that arose before termination.

Provisions that reasonably should survive termination will continue to apply.

Section 29 — Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or severed as necessary.

The remaining provisions will continue in full force and effect.

Section 30 — No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

A waiver is effective only when made in writing by an authorized representative of Britique Boutique LLC.

Section 31 — Entire Agreement

These Terms, together with all policies and specific terms incorporated by reference, constitute the entire agreement between you and Britique Boutique concerning your use of the website and Services.

They supersede prior or contemporaneous communications relating to the same subject matter.

Section 32 — Governing Law and Venue

These Terms and any separate agreement through which we provide Services will be governed by and interpreted according to the laws of the State of Georgia, without regard to conflict-of-law principles.

To the extent permitted by applicable law, any legal proceeding arising from these Terms or your use of the Services shall be brought in a court of competent jurisdiction located in Houston County, Georgia.

Nothing in this section deprives a consumer of protections, rights, or venue options that cannot legally be waived.

Section 33 — Changes to These Terms

We may update or replace these Terms by posting a revised version on this page.

The updated Terms will become effective on the date stated in the revised version unless otherwise required by applicable law.

Your continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.

The version in effect when an order is placed will generally govern that transaction.
